Planning Committee was called to order at 6:34 p.m. in the Council Chambers.

Mayor Bennett declared an interest in Item 4 (Report PLPD12-088, Lansdowne West Secondary Plan), as he is the owner of property within the subject area.

Part Lot Control Exemption

That Council approve the recommendation outlined in report PLPD12-065 dated October 29, 2012, of the Manager Planning Division, as follows:

 

That a by-law be enacted to temporarily remove Part Lot Control from Blocks 343 to 353, inclusive, of Plan 45M-234, as permitted under Section 50(7) of the Planning Act for the purpose of conveying parcels of land appropriately associated with the development of 58 linked dwelling units, each to be held under separate ownership.

Fernand Samson, 916 Western Avenue, spoke in opposition to the application. 

 

Alan McLaren, 915 Western Avenue, spoke in opposition to the application.

 

 

The applicant, Barbara Joyce, spoke to the application.

That the application be referred for two cycles to permit the applicant and neighbour(s) to discuss the application.

Public Meeting Under the Planning Act

Report PLPD12-068

Lansdowne West Secondary Plan

 

Due to his previously declared conflict, Councillor McWilliams did not discuss or vote on this item. 

 

Councillor McWilliams left the meeting at 7:50 p.m. and returned at 7:56 p.m.

 

Due to his previously declared conflict, Mayor Bennett did not discuss or vote on this item.

 

Caroline Kimble, Land Use Planner provided an introduction to this item.

 

No one spoke in opposition to the recommendations in the report. 

 

Kevin Duguay, 560 Romaine Street agent for both the Mercedes Benz dealership and 545 The Queensway spoke to the report.  The owners of 545 The Queensway are requesting changes to Cameron Place to improve the intersection.

That Council approve the recommendations outlined in Report PLPD12-068 dated October 29, 2012, of the Manager, Planning Division, as follows:

 

a)         That the proposed amendments to Section 4.4.5.2 – Prestige Industrial; Section 4.4.5.3 – Service Industrial; Section 10.2 – Lansdowne West Secondary Plan; Schedule ‘M’ – Lansdowne West Secondary Plan; and to Schedule ‘O’ – Industrial Land Use, of the City’s Official Plan for the properties located east of Byersville Creek, south of The Parkway and north of Highway 7/115, be approved in accordance with Exhibit ‘D’ attached to Report PLPD12-068.

 

b)        That an amendment be initiated to the City’s Comprehensive Zoning By-Law #1997-123 to implement the changes in land use anticipated by the Amendments to Sections 4 and 10 of the Official Plan, and Schedule M – Lansdowne West Secondary Plan and Schedule O – Industrial Land Use.

 

 

 

Committee at it’s meeting of October 29, 2012 made the following recommendation:

 

c)         That the Official Plan Amendment by-laws be withheld from passage pending a review of the implementing zoning by-law with interested parties.

Report PLPD12-062

485 Parkhill Road East

Proposed Telecommunication Structure

 

Councillor Pappas questioned whether the application by SBA Canada is reconsideration as this matter had come before Council previously.  Councillor Hall ruled that the application is a reconsideration and therefore requires a 2/3 vote.

 

Councillor Vass challenged the ruling of the Chair, and the Chair’s ruling was not upheld.

That Council approve the recommendations outlined in Report PLPD12-062 dated October 29, 2012, of the Manager, Planning Division, as follows:

 

a)         That Industry Canada be advised that the proposal for a telecommunication structure by SBA Canada, ULC, at 485 Parkhill Road East, has been processed in accordance with the City of Peterborough’s Telecommunications Structures Policy and Procedure.

 

b)        That Industry Canada be further advised that the proposal for a telecommunications structure at 485 Parkhill Road East has generated concern from the public as documented by The Biglieri Group and summarized in Exhibit E of Report PLPD12-062.

That the recommendations be amended as follows:

 

c)         That the City does not support the application as it does not conform to the City of Peterborough’s cell tower policy, as it does not meet the required 120 m setback from lands zoned residential.

 

“CARRIED”

 

 

Upon the main motion of Councillor Doris, as amended, the motion carried.

 

 

Other Business

 

Councillor Juby requested a report in 2013 regarding a declaration that states that the City of Peterborough does not support any cell tower applications that do not meet the City's cell tower policy.  

 

The Mayor will contact Industry Canada regarding a previous request for them to attend a Council meeting to discuss the Cell Tower issue.
